PARTICIPANT RELEASE OF LIABILITY & ASSUMPTION OF RISK WAVIER AGREEMENT

ORGANISATION NAME: Fitness Runs in the Family Ltd, Trading As Her Strength

I acknowledge and agree that by participating in any way or by observing the activities or using the equipment offered by Her Strength there are inherent risks. I acknowledge and agree that:

1) The risks from the activities involved are significant, including the risk of injury, permanent injury, disability and death.

2) I knowingly and freely assume complete responsibility and liability for all associated risks, and for any injury that may result from these risks. This relates to risks both known and also those risks which are not forseeable at the time of signing this agreement. This also includes any risks arising from the negligence of the releasees or others.

3) I willingly agree to comply with all terms and conditions of participation, including rules or instructions given verbally by the class instructor.

4) If I observe any unusual or significant hazard during my presence or participation in the activity, I will remove myself from participation and bring such to the attention of the class instructor.

5) I will notify Her Strength staff if I suffer from any medical, health or other condition that may cause injury to myself, others or may require emergency care during my participation.

6) I, for myself, and on behalf of my family, heirs, next of kin, or other representatives hereby release, indemnify and hold harmless Fitness Runs in the Family ltd (Trading as Her Strength), it’s owners, officers, officials, employees, other participants, and owners and lessors of premises used to conduct the activities (the releasees) from any and all claims, demands, losses and liability arising out of or related to any injury, disability or death I may suffer.

7) I understand that by voluntarily assuming all risks involved I am fully responsible for my participation and I will be solely responsible for any loss or damage I sustain including personal injuries to me, damage to my property or damage arising out of my death whether caused by negligence, accident or otherwise.

8) I understand that Her Strength takes no responsibility for any person who accompanies me to be present at or observe the class. If a participant needs to bring a child to the class the child is under the sole care of their responsible adult and it is up to that participant to ensure that any such child does not partake in the class or try to use any of the equipment or interfere in the class in any other way. No persons other than those who have booked and paid for their participation at the class will be able to participate.

Media statement: by agreeing I hereby grand permission to Her Strength to use photographs and videos of me taken while present at or participating in the class online, on social media, in publications, and other communications related to the mission of the Her Strength business.

I have read this release of liability and assumption of risk wavier, fully understanding it’s terms, understand that I have given up substantial rights by agreeing to it, and agree with it freely and voluntarily without inducement.
